Licensed insurance intermediaries need to do their best to help customers obtain suitable insurance protection, but at the same time are under great pressure to complete principal companies' sales targets. For examples, licensed intermediaries on one hand are appointed by clients to assist them paying premiums, and on the other hand they have to participate in sales activities arranged by their principals. Being fully occupied by busy works, it is easy to touch the regulator's red lines by mistake.

To assist licensed intermediaries getting rid of unnecessary trouble, this course lists out the common misconducts intermediaries commonly committed and the popular complaints filed by clients. Taking these misconducts and complaints as examples, you will understand the corresponding regulatory requirements, how to avoid violating regulatory requirements in your daily work, and how to defend your case if you are unfortunately subjected to clients' complaints.

The course covers a wide range of topics, including what to look out for when assisting customers in handling premium payment, the standard of conduct when participating in sales booth activities, what to pay attention to when explaining insurance policies, etc. All topics discussed have real cases for reference.

Since the Insurance Authority often receives complaints about policyholders being "misled" by licensed intermediaries, this course specifically explains the elements of "misleading" (or misrepresentation) from legal perspective, and the defenses that tribunals and courts will accept when complaints are made against you.

Finally, we will also explain the process of handling complaints of misconduct cases by the Insurance Authority, and let you understand how to protect your own rights and interests if you are unfortunately subjected to summons due to misconduct complaints.


Course Outline
This course focuses on assisting licensed intermediaries to establish good practice in various aspects so that they can avoid unnecessary complaints of violations of regulatory requirements. In case when facing complaints, how licensed intermediaries should defence their cases.
 
In this regard, this course firstly explains the full procedures of receiving misconduct complaints by the IA, and how IA opens inspection files, performs investigations, and how IA hears the cases and adjudicates disciplinary sanctions. 
 
Then, by referring to a number of real cases, we will share the following misconducts commonly committed by intermediaries, and explain how intermediaries should avoid committing similar misconduct behaviours, and also how insurance intermediaries unfortunately subjected to complaints should defend themselves:
  • Assist clients in processing premium payments
  • Participate in street sale events
  • Explain insurance policies, especially the complexities and risks involved in premium financing
  • Lobby clients to switch insurance policies
Since many misconduct complaints involve the element of "misleading" or misrepresentation, the third section of this course explains the criminal elements of misleading from the perspective of law and court cases, and shares the defensible grounds to enable intermediaries building better defence of misleading.
 
Finally, the IA has shared its expectations that licensed intermediaries should filed self-reports proactively for any misconducts. Once a licensed intermediary finds himself has committed misconduct, the submission of a complete self-report can greatly reduce the magnitude of disciplinary sanctions.
